Welcome to Dermasift. These Terms of Service ("Terms") govern your access to and use of the Dermasift website, mobile applications, and related services (collectively, the "Service"), operated by Dermasift ("we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Service.

1. Nature of the Service

Dermasift is an informational platform that provides AI-powered cosmetic ingredient analysis, product information, and skin-related educational content. We are not a medical provider, pharmacy, or dermatological clinic.

The Service is designed to help consumers make informed decisions about cosmetic products by providing general information about ingredients, formulations, and potential ingredient interactions.

2. No Medical Advice

The information provided through the Service does not constitute medical advice, diagnosis, or treatment. All content — including ingredient analyses, concern scores, interaction warnings, personalized predictions, and AI-generated insights — is provided for informational and educational purposes only.

You acknowledge and agree that:

• The Service is not a substitute for professional dermatological or medical advice.
• You should always consult a qualified healthcare provider or dermatologist before making changes to your skincare routine, especially if you have existing skin conditions, allergies, or sensitivities.
• You should always perform a patch test before using any new product, regardless of any information provided by the Service.
• We do not claim that any product or ingredient will "treat," "cure," "heal," or "prevent" any condition.

3. AI-Generated Content Disclosure

Portions of the information displayed on the Service — including but not limited to ingredient descriptions, product descriptions, concern scores, ingredient interaction analyses, and personalized insights — are generated or enriched by artificial intelligence (AI) systems.

You understand and acknowledge that:

• AI-generated content may contain inaccuracies, errors, or omissions. While we make reasonable efforts to ensure quality, no automated system is infallible.
• AI analyses are based on general cosmetic chemistry knowledge and may not account for your individual circumstances, skin conditions, medications, or allergies.
• The accuracy of personalized analyses depends on the accuracy and completeness of the skin profile information you provide.
• We clearly label AI-generated content where feasible. Look for "AI-analyzed" badges throughout the Service.

4. Data Accuracy

We aggregate data from multiple sources, including established cosmetic databases (CosIng, Open Beauty Facts), published research, and AI enrichment. While we make reasonable efforts to ensure accuracy, we do not guarantee that any information on the Service is complete, current, or free from error.

If you believe any information is inaccurate, you may use the "Report inaccuracy" feature available on product and ingredient pages. We will review reports and make corrections where appropriate.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DERMASIFT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Adverse skin reactions, allergic reactions, or any physical harm resulting from using products based on information from the Service.
• Losses arising from reliance on AI-generated content.
• Any damages resulting from inaccuracies in product, ingredient, or interaction data.
• Any damages from unauthorized access to your account or personal data.

Our total aggregate liability to you for all claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or fifty US dollars (USD $50), whichever is greater.

6. User Responsibility

By using the Service, you agree to:

• Patch test all new products before full application, regardless of any analysis provided by the Service.
• Consult a healthcare professional for any medical concerns, skin conditions, or before making significant changes to your skincare routine.
• Provide accurate information in your skin profile if you choose to use personalized features.
• Use the Service at your own risk and exercise your own judgment in making product choices.
• Mobile permissions: if you use our mobile apps, you choose whether to grant access to the camera or photo library for optional features (such as label scanning or skin snapshots). You are responsible for any content you capture or upload.

7. User Accounts

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You must provide accurate, current, and complete information during registration and keep your account information up to date.

8. User-Submitted Content

Users may submit product information, product reviews, and ratings through the Service. By submitting content, you represent and warrant that:

• The information you submit is accurate to the best of your knowledge.
• You have the right to submit such information.
• The content does not infringe on any third party's rights.
• Reviews and comments are lawful, not harassing or defamatory, and reflect your honest experience to the best of your knowledge.

User-submitted content is subject to moderation and may be modified, enriched with AI analysis, or removed at our discretion. User-submitted products are labeled as "Community" submissions and may not have been independently verified. Reviews may be displayed publicly with your display name or profile identifier as shown in the Service.

By posting reviews or other content, you grant Dermasift a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute that content in connection with operating and promoting the Service.

9. Subscriptions and Payments

Certain features of the Service require a paid subscription ("Premium"). Subscription payments are processed through Stripe. By subscribing, you agree to Stripe's terms of service in addition to these Terms.

Subscriptions auto-renew unless canceled before the renewal date. You may cancel your subscription through the web dashboard, through in-app subscription management where we offer it, or through your mobile platform's subscription settings (for example, Apple App Store or Google Play) if you subscribed there. Refunds are handled in accordance with our refund policy and applicable store rules.

10. Indemnification

You agree to indemnify, defend, and hold harmless Dermasift and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

• Your use of the Service.
• Your violation of these Terms.
• Your violation of any rights of another party.
• Any content you submit to the Service.

11. Intellectual Property

The Service and its original content (excluding user-submitted content), features, and functionality are owned by Dermasift and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from the Service without our prior written consent.

12. Account Termination and Deletion

You may delete your account at any time. Upon deletion, we will:

• Remove your personal profile data, skin profile, and account credentials.
• Retain anonymized, aggregated data that cannot be linked back to you for analytical purposes.
• Cancel any active subscription (no further charges will occur, but the current billing period will not be refunded unless required by law).

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent or abusive behavior.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or that any information provided will be accurate, complete, or current.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, unless you are located in a jurisdiction that provides you with a right to litigate in court.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
